Area
any and all inner and outer harbours situated within the limits of IJmuiden, Velsen, Beverwijk, Zaandam, Amsterdam and the entire North Sea Canal, including but not limited to all roads, anchorages, locks, docks, berths and moorings adjacent and belonging thereto
Towage
the employment of a tug to move, escort or otherwise assist any vessel or any floating abject, whether with or without self propulsion, within the Area, salvage services excluded
Tug
any self-propelled vessel employed for towage on behalf of Svitzer
Additional conditions:
- This tariff shall be applicable to all "Towage" preformed by Svitzer, whether or not under a Svitzer Towage Contract
- In case this tariff is applicable to "Towage" preformed under a Svitzer Towage Contract is not to be interpreted in its own right, but in conjunction with and as part of this Svitzer Towage Contract. Should there be any conflict between this Tariff and the Svitzer Towage Contract, the latter shall prevail.
- In addition to the rates indicated herein, a surcharge of 25% of the Tariff shall apply to "Towage preformed:
- A) From Saturday 00.00 hrs. till Sunday 24.00 hrs.
- B) On official national holidays from 00.00 hrs. till 24.00 hrs.
- C) In case of a visibility of less than 500 meters, according to the data of the official Pilot and Radar Service ( Waiting, Cancellation and Overtime excluded.)
- The rates of this Tariff include the use of tug's hawsers.
- All services rendered by Svitzer, salvage services excluded, shall be governed by the Wijsmuller Algemene Bedrijfsvoorwaarden (Svitzer General Conditions) as lastly filed at the office of the Clerk of the Amsterdam District Court. All Towages shall furthermore be subject to the Nederlandse Sleepdienstenconditieën 1951 ( Netherlands Tug owners Conditions 1951) as lastly filed at the office or the Clerk of the Amsterdam and Rotterdam District Courts. Copy of same will be forwarded upon request, free of charge.
- In case of any conflict between the Wijsmuller Algemene Bedrijfsvoorwaarden and the Nederlandse Sleepdienstenconditieën 1951, the latter shall prevail. T
- he official language of the Tariff will be English. The Tariff shall be subject to Dutch Law. Any dispute arising in connection with this Tariff shall be settled amicably, failing which same shall be referred to arbitration to the rules of the "Nederlands Arbitrage Instituut" (Netherlands Arbitration Institute). The arbitral award shall be final and unconditionally binding.
